How to Register a Death
 

Documents required with English / Arabic translation for registration for death cases / issue of ‘No Objection Certificate’ (NOC) for local burial / transportation of the mortal remains to India as per wishes of the family:
 
1. Medical report indicating the cause of death, with English translation.
 
2. Copy of detailed police report with English translation (in case of unnatural deaths i.e traffic accident, Industrial accident, murder, suicide etc). 

3.   Consent letter from family in India for local burial/transportation of mortal remains to India (duly attested by  a Notary). If the family has any suspicion on the death, this may be conveyed in the consent letter so that the matter could be  taken up with Saudi authorities for post mortem and police investigation. Police conducts  investigation/post mortem in unnatural death, in  case of doubt.The family may be advised to send a copy of consent letter to Embassy of India’s Fax No. 00966-11-4810742 or email cw@indianembassy.org.sa   Tel-011-4884144 Ext No.119,109. 4.  Copy of Iqama  and Passport (first, last and visa pages) of the deceased.

5.     Copy of Identity card of Attorney (copy of passport and Iqama for foreigners (non-Saudis) / copy of Bathaqa (Identity card) for Saudi nationals.

6.     Letter from sponsor/Company addressed to the Embassy undertaking to settle financial dues, arrears of pay, service benefits, insurance, death compensation (applicable in case of traffic accident where the other party is held responsible, full or partially, for the accident, as decided by the Saudi authority) of the deceased / Saudi General Organisation for Social Insurance (GOSI) details in case of industrial accident (if insurance with GOSI).  The cheque for legal dues are made in favour of Ambassador of India,Riyadh, for onward disbursement to the legal heirs of the deceased.  The cheques are sent by the Embassy to the concerned district magistrate / collector for disubursement of the amount, after due veification of legal heirship.

7.    Blood money (as compenstion) is generally due in the case of murder, as per the wishes of the family of the deceased.  In the case of indusrial accident, duly certified by the competent Saudi authroity, compensation from the GOSI  is admissible.  As per Saudi rule, GOSI directly deals with the legal heirs of the deceased.  There is no compensation made in cases of suicidal death.

DOCUMENTS REQUIRED FOR PURSUING THE CASE OF DEATH  COMPENSATION IN PUBLIC COURTS OF SAUDI ARABIA ON BEHALF OF THE LEGAL HEIRS OF THE DECEASED
 
1.          LEGAL HEIRSHIP CERTIFICATE (LHC)in English with Arabic Translation
This should be obtained from the competent authorities of respective state governments in India.  The legal Heirship certificate should indicate the names, in FULL EXPANDED FORM (without initials) and not shortened forms of all legal heirs including minors.  Age and relationship of each legal heir with deceased person should be mentioned.  Guardian’s name in respect of minor children should be mentioned.

2.             POWER OF ATTORNEY (POA) in English with Arabic Translation
This should be signed and executed by all the legal heirs including minor children mentioned in the legal heirsincluding minor children mentioned in the legal Heirship Certificate.  Persons who cannot sign should put their thumb impression (left hand thumb for male and right thumb for female).  Guardian should sign compulsorily on behalf of minor legal heirs.  Power of Attorney should be executed in favour of any of your relative/friend/representative or any other person who can attend the court proceedings on behalf of legal heirs
 
(If you wish to nominate this Embassy as your legal attorney, then the Power of Attorney should be executed in favour of Ambassador of India, Riyadh (Saudi Arabia) with powers to nominate any of the officers of the Embassy).
 The English & Arabic versions of POA & LHC documents are to be got attested by the authorities mentioned below before submission with court in Saudi Arabia.  This is a mandatory legal requirement in the Kingdom of Saudi Arabia.  Formats of LHC & POA are approved as accepted by Saudi Public Courts.  As such, no change in the language of LHC & POA should be made.

II).            Consular Section, Ministry of External Affairs, Patiala House, New Delhi (or) any Branch Secretariat of Ministry of External Affairs at Kolkata/Chennai/Hyderabad.
III).           Saudi Embassy, New Delhi or Saudi Consulate General, Mumbai.

I).  Saudi Ministry of Foreign Affairs, Riyadh.
 II).  Ministry of Justice in Riyadh.

iii).           We agree and under take to ratify and confirm whatever our attoney may lawfully do by virtue of the powers hereby given.
 
iii).           The minor children mentioned above at Sl. No.       are under the care of Mr./Mrs. _____________________ (relationship with the minors to be mentioned) who is the legal guardian and has signed on their behalf.

iii).           Sub-para (iii) in respect of Guardian of minor legal heirs should be COMPULSORILY filled.             
iv).           This document has been prepared as per requirement of Saudi courts.  Therefore, NO CHANGE IN THE FORMAT OR LANGUAGE OF FORMAT SHOULD BE MADE.
