TECHNICAL EDUCATION
NOTIFICATION
NEW DELHI, THE JANUARY 21, 2004
No. F. 37-3 /Legal/2004 - In exercise of the powers conferred by sub
section (j) and sub-section (o) of section 10 read with sub-section (1) of
section 23 of the All India Council for Technical Education Act, 1987 (No.
52 of 1987), the All India Council for Technical Education hereby makes
the following regulations, in supersession of AICTE Regulations No. F.
37-3(ii)/Legal/ AICTE, which was notified in Official Gazette on March 31,
2001, and the Regulations No. 26-7/Legal/2002, dated April 24, 2002,
notified in the Official Gazette on April 29, 2002.
1. Short title and commencement -
(i) These regulations may be called the All India Council for Technical
Education (admission under supernumerary quota for Foreign Nationals/
Persons of Indian Origin (PIOs)/ Children of Indian Workers in the Gulf
Countries, in AICTE approved Institutions) Regulations, 2004.
(ii) These shall come into force on the date of publication in the
Official Gazette.
2. Applicability -
These regulations shall be applicable to the Foreign Nationals/ Persons of
India Origin (PIOs) / Children of Indian Workers in the Gulf Countries
seeking admission to AICTE approved Institutions.
3. Definitions
Unless the context otherwise requires;
(a) Persons of Indian Origin (PIO) :- shall mean the Persons who are
citizens of other countries (except Pakistan and Bangladesh) who at any
time held an Indian Passport, or who or either of his parents or any of
his grand parents was a citizen of India by virtue of the provisions of
the Constitution of India or Sec 2 (b) of Citizenship Act, 1955 ( Act No.
57 of 1955).
(b) Foreign Nationals : Shall mean the citizens of all countries other
than India, who are not of Indian origin as defined under PIO.
(c) Foreign Student : Shall mean, in this context, as the student who
possesses a foreign passport.
provided that any subsequent changes in the definition as may be notified
by the Government of India shall have the same latest meaning respectively
assigned to them. The other expressions not defined herein shall have the
meaning as may be assigned in any subsequent notification of Government of
India.
4. Admission:
(a) Foreign Nationals / PIOs/ Children of Indian Workers in the Gulf
Countries.
Under these Regulations fifteen percent (15%) seats in all the
institutions / University Departments, approved by AICTE, offering
technical courses leading to Diploma, Degree and Post- Graduate Degree in
Engineering & Technology, Architecture & Town Planning, Pharmacy, Applied
Arts, MBA & MCA, Hotel Management & Catering Technology, shall be allowed
on supernumerary basis from amongst Foreign Nationals / Persons of Indian
Origin (PIOs) / Children of Indian Workers in the Gulf Countries, over and
above the approved intake, provided that 1/3rd of the 15% shall be
reserved across different disciplines in the educational institution, for
the Children of Indian Workers in the Gulf Countries. However, any vacant
seats out of 1/3rd category shall be reverted to the quota of 2/3rd meant
for PIO / Foreign Nationals.
This is subject to the availability of adequate infrastructural facilities
in the applicant institutions, to be verified by AICTE, based on its Norms
and Guidelines. These supernumerary seats shall be exclusively meant for
these category of students in the diploma, under-graduate and
post-graduate courses with a rider that under no circumstances a seat
remains unfilled shall be allocated to any one other than a foreign
student / PIO. Foreign Nationals / Persons of Indian Origin (PIOs)/
Children of Indian Workers in the Gulf Countries admitted in an AICTE
approved institutions through Indian Council for Cultural Relations (ICCR)
or as Government of India nominee shall be included within this 15%
ceiling.
(b) Guidelines
The institutions fulfilling the following criteria shall be eligible to
apply for approval of AICTE for admitting students under these
Regulations:-
(1) The Institutions should be able to provide suitable hostels/
residential accommodation to the Foreign Students/ Persons of Indian
Origin (PIOs) and the Children of Indian Workers in the Gulf Countries.
(2) The teacher-student ratio in the respective discipline where Foreign
Nationals / Persons of Indian Origin are to be admitted should not be less
than 1:15.
(3) The institutions must have a modern library as per norms & standards
of AICTE with multi media facilities.
(4) The total plinth area of the institution (excluding hostels and
residential areas) is not less than 12.5 sq. mtrs. per student.
(5) The Institution and it’s hostels must have proper approach road, good
environment, sufficient water supply and an arrangement for generators in
absence of normal supply of electricity.
(6) The concerned institutions must not have been put under “No Admission”
or “Reduced Intake” category by AICTE due to poor infrastructural
facilities during the past 3 years.
(7) The institution must have been functioning at least for a period of 5
years after AICTE’s approval.
(8) The results (success rate) of last two batches of final year students
must not be less than 75%, calculated based on number of students appeared
in the final examination, vis-à-vis the students passed.
The AICTE shall satisfy itself the availability of Infrastructural
facilities suitable for admitting students under this supernumerary
category, through an inspection team, wherever necessary. For this
purpose, the institutions meeting the above criteria, may submit Status
Report alongwith written request to AICTE for inclusion of the
institutions under the list of eligible institutions for admission of
Foreign Nationals /PIOs/ Children of Indian Workers in the Gulf Countries.
The AICTE shall examine the Status Reports and the Report of inspection
team and will include only those institutions fulfilling all the above
criteria. The AICTE shall subsequently communicate the list of such
institutions to the competent authority, in the respective State
Government / UT, for admission.
(c) The admission under these Regulations shall be made on merit amongst
the applicants under the Foreign National and PIO Category.
5. Fees
The concerned State Government / UT shall notify the tuition and other
fees for candidates to be admitted under Foreign National / Persons of
Indian Origin (PIOs) Category. There shall be no NRI fees. The Children of
Indian Workers in the Gulf Countries shall be treated at par with resident
citizens.
